Last updated: 16/4/26 These Terms and Conditions apply to all courses, training, events, and services (“Services”) provided by Beyond The Path (“we,” “us,” or “our”). By booking or participating in any of our activities, you (“the participant” or “you”) agree to be bound by these Terms.
1. Use of Website and Services
By accessing this website or booking any of our activities, you confirm that you are at least 18 years old, or have the consent of a parent or guardian. You agree to use our Site and Services lawfully, respectfully, and in accordance with these Terms. We reserve the right to make updates or improvements to the Site or Services at any time.
2. Payment Terms
Payment terms, refund policies, and cancellation conditions are supplied separately at the time of enquiry and will form part of your agreement with us once you confirm a booking. These specific terms take precedence over any general statements in this document relating to fees or cancellations.
3. Health, Safety, and Risk
Participation in wilderness, bushcraft, or outdoor activities carries inherent risks, including potential injury, illness, or loss. By taking part, you acknowledge and accept these risks as an unavoidable part of the experience.
You must follow all safety instructions provided by our instructors.
Failure to do so may result in removal from the activity without refund.
You must disclose any medical conditions, recent injuries, or disabilities that could affect your participation.
We reserve the right to refuse participation if we believe a condition or behaviour could compromise safety.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence.
4. Changes to Courses and Activities
We continually assess conditions to ensure a safe and high-quality experience. As such, we reserve the right to:
Modify the itinerary, location, duration, or content of any course or activity due to safety concerns, unsuitable weather, instructor availability, or other operational reasons.
Cancel or reschedule an activity if minimum booking numbers are not met or if circumstances make the event unsafe or impractical to run.
Where possible, participants will be offered an alternative date, credit, or voucher valid for at least 12 months. If none of these options are suitable, refunds will be handled in line with our separately supplied payment terms.
5. Conduct
We may remove any participant from an activity if their actions compromise safety, wellbeing, or enjoyment of others. Disruptive or unsafe conduct, or being under the influence of alcohol or drugs, will result in immediate exclusion without refund.
6. Equipment and Property
All essential safety equipment will be provided unless stated otherwise. Participants are responsible for their own personal belongings, travel arrangements, and any equipment brought to the activity. Deliberate damage to our equipment will be charged at full replacement value.
7. Force Majeure
We are not liable for cancellations or changes due to events beyond our reasonable control (for example, severe weather, natural disasters, government restrictions, or illness). Where practicable, we will offer an alternative date, credit, or voucher valid for at least 12 months.
8. Intellectual Property
All content on this website including course materials, text, photography, videos, and branding is owned or licensed by Beyond The Path. You may not reproduce, distribute, or use our materials for commercial purposes without written permission.
9. Privacy and Data Protection
We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Personal data provided in booking forms is used only for course administration, safety, and communication. We will not share your data with third parties without consent, except where required by law. Our Privacy Policy contains full details of how we collect and use personal data.
10. Photography & Media Release
We may take photos and videos during our activities for use on our website, social media, and marketing materials. By attending, you agree that Beyond The Path can use images or recordings that include you for these purposes, without payment. If you prefer not to appear in photos or videos, please let us know in writing before the activity. We will do our best to respect your request, though this may not always be possible in group settings. All media remains the property of Beyond The Path.
11. Liability
Except as required by UK law, we are not liable for any indirect or consequential loss, damage, or expense arising from your participation. You are responsible for arranging your own travel and personal insurance to cover cancellation, medical treatment, and personal belongings.
12. Governing Law
These Terms and any disputes arising from them are governed by and construed in accordance with the laws of England and Wales, and subject to the exclusive jurisdiction of the English courts.
